THE CSPS OPPOSES AB 72 - PLEASE CONTACT THE GOVERNOR FOR HIM TO VETO!

CSPS opposes the AB 72 because it tips the scales in favor of payers at the expense of providers through a flawed payment standard of paying the greater of 125% of Medicare or the average contracted rate for the same service as determined by the payer. AB 72 does not provide enough specificity or transparency on how the average contract rate is determined to ensure the payers will not manipulate the rate in their favor.

Manipulating data to the payers favor is exactly what was found to have happened after the AMA, various state medical societies, and then Attorney General Andrew Cuomo sued multiple payers for their manipulation of the Ingenix Database resulting in patients paying more than what they were required under their health insurance product. The payers ended paying more than $600 million dollars to settle the lawsuits. Our members fear history will repeat itself

We are also concerned the new payment standard in AB 72 will act as a disincentive for payers to fairly contract. Existing contracts at rates higher than what the payers determine as the average contract will be cancelled because they can simply pay the lower average contact rate.
